This is one of those days in which a breaking story changed plans and the schedule. Yesterday afternoon, the Ninth Circuit Court of Appeals issued its ruling on the April 2025 App Store anti-steering injunction decision. Today’s update will be dedicated to analyzing the ruling and the accompanying implications. There’s a lot to unpack. We begin with the ruling itself. The discussion then turns to why Neil thinks both sides can claim a victory with the ruling. The update then turns to what may happen with Apple’s fees / commissions applied to app link-outs.

Last Friday, Judge Yvonne Gonzalez Rogers issued her ruling in the Epic Game vs. Apple trial. Over the weekend, I finished my first full read through of her ruling (185 pages). The ruling is available here. My notes totaled approximately 7,000 words which included plenty of key quotes and passages. For today’s update, the goal is to narrow the focus to my initial thoughts on the ruling.

We look at why Amazon would be interested in MGM and why Apple passed on MGM a few years ago when it kicked the company’s tires.

We go over my thoughts on Cook’s grilling and what it tells us about the judge’s upcoming ruling. The update then turns to interesting comments from Snap’s Evan Spiegel regarding the App Store. We look at how the point being raised by Spiegel is something that also serves as a backdrop to the Apple vs. Epic Games trial. We conclude with a discussion of Snap unveiling its fourth version of Spectacles and why I continue to disagree with Snap’s hardware strategy.
